NYCDOT "Double Billed" the Federal Highway Administration for nearly $97,000 on the original BHRA Red Hook Streetcar project.  Then NYCDOT "Framed" BHRA.  Finally, NYCDOT "Scuttled" And Then Physically Destroyed The Original Red Hook Streetcar Project To "COVER IT UP" :(

Here are the original NYCDOT DOCUMENTS PROVING THIS  - DO THE SIMPLE ARITHMETIC FOR YOURSELF:

Page 1: Official NY State DOT document says NYCDOT received $321,079 in Federal project "Reimbursement Funds". PROBLEM: During the time period in question (NYC "Fiscal Years"1998 and 1999), THERE WAS ONLY $209,970 IN FEDERAL REIMBURSEMENT FUNDS AVAILABLE TO THE PROJECT 

Page 2- 4: Official NYCDOT documents prove the fact that only $209,970 was available- and that BHRA Exceeded the required "Local Match" (Materials Only- NO CASH FROM BHRA REQUIRED).

Page 5 - 9: A (circa 2002) NYCDOT Created "Ledger Sheet", indicating that between July 24, 1997 and July 12, 1998, NYCDOT "Invoiced" the Federal Highway Administration (FHWA), via NY State DOT, a total of $306,000 for "Reimbursement" - when only $209,970 was available under the Federal and State funding contracts >:(

NYCDOT "Double Billed" the Federal Highway Administration for $96,736.04 >:(

Pages 10 - 14: Actual BHRA Invoices # 4 - 6, submitted by BHRA to NYCDOT for Reimbursement- AND a circa July 31, 1998 letter from NYCDOT Denying payment for BHRA Invoice #7 (the start of NYCDOT's "Cover Up"- NYCDOT thought it could hide behind the project's "Phase II" EXTENSION "CEQR" and "ULURP" process indefinitely).
NOTE: BHRA Invoice #7 requested Reimbursement of $20,993.

Together, these financial documents PROVE that NYCDOT's own Invoices # 4-7, which they submitted to the Federal Highway Administration for Reimbursement via NY State DOT during NYC "Fiscal Years" 1998 and 1999 are "DOUBLE BILLING" 

Pages 15 - 24: For 2 years, NYCDOT itself inexplicably blocked the start of the "CEQR" and "ULURP" processes (NYC approval processes required for "Phase II" - a 5 block EXTENSION onto Red Hook STREETS, of BHRA's streetcar line already built by BHRA, and then operating on Greg O'Connell's waterfront property), from August 15, 1996 when NYCDCP first notified NYCDOT of the requirement, until late 1998, when NYCDOT finally permitted the "CEQR" and "ULURP" processes to begin.
 
BHRA successfully completed the exhaustive "PHASE II" NYC "CEQR" and "ULURP" processes on June 14, 1999 and December 8, 1999 respectively.  During the Planning Commission vote, NY City Planning Commissioner Anna Hayes Levin (still serving today) stated "I love this project, I'm very happy to vote yes".

Pages 25 - 31: Next, after a still further inexplicable NYCDOT delay of yet another year, during the late Fall of 2001, the Federal Highway Administration, NY State DOT and BHRA succeeded in "persuading" NYCDOT to allow BHRA to commence construction on "Phase II" of the Red Hook Streetcar Project- the 5 block project EXTENSION onto Red Hook STREETS...

Pages 32 - 52: Finally, in early January 2002, when the Project was supposed to advance into “Phase III”  (the FURTHER extension of the Red Hook Streetcar line to the Borough Hall transportation nexus), thereby requiring NYCDOT having to  “go back to the well” (FHWA) for more Federal money, NYCDOT FRAUDULENTLY demanded $98,000 from BHRA to "Cover Up" the $97,000 NYCDOT "Workers" PREVIOUSLY STOLE from the FHWA... 
 
NYCDOT also began its own "MEDIA COVER UP/ DISINFORMATION CAMPAIGN", and finally During 2002 - 2003, NYCDOT ILLEGALLY SCUTTLED AND PHYSICALLY DESTROYED THE FEDERALLY FUNDED PROJECT. 
 
THIS ALL TO “COVER UP” the $97,000 that NYCDOT had previously “Double Billed” the Federal Highway Administration for During NYC's “FY” 1998 and 1999 >:( 

It's clear that certain NYCDOT “MISCREANT WORKERS” never read PLUNKITT OF TAMMANY HALL: NYCDOT broke Plunkitt's first Cardinal Rule- NYCDOT engaged in “DISHONEST GRAFT”- NYCDOT's “Books” WERE NOT IN ORDER…

HOW MUCH MORE STUPID AND ARROGANT COULD THEY HAVE BEEN – AND IN FACT, STILL ARE?

While the names of the NYCDOT STRAIGHT UP “WHITE COLLAR CRIMINALS” WHO STOLE $97,000 FROM THE FEDERAL HIGHWAY ADMINISTRATION DURING NYC's “FY” 1998 And 1999 Are Not YET Known, The Names Of The NYCDOT “WORKERS” Who CONSPIRED AND EXECUTED The Ensuing “COVER UP” ARE KNOWN: ROBERT GROTELL, FRANCO ESPOSITO, ANNE KOENIG, TOM COCOLA.

Is this decades old "White Collar Crime" of "Double Billing" the FHWA committed by certain NYCDOT "Workers", CONTINUING TO BE ACTIVELY COVERED UP BY THE VERY SAME MISCREANTS STILL EMPLOYED AT NYCDOT TODAY? 

Both NYCDOT Senior Legal Counsel FRANCO ESPOSITO and NYCDOT Director Of Franchises ANNE KOENIG, ARE KNOWN TO HAVE ACTIVELY PARTICIPATED IN THE ILLEGAL SHUT DOWN OF THE ATLANTIC AVENUE TUNNEL TOURS IN 2010.
 
Tom Cocola is NYCDOT Staten Island Boro Commissioner; former NYCDOT Deputy Commissioner Robert Grotell sometimes works as a "Plane Noise Consultant" for both NYCDOT, and the Port Authority Of New York And New Jersey.  
 
Does this help explain why NYCDOT hired "SHILL ANTI- STREETCAR CONSULTANT" NELSON NYGAARD (David Fields, Michael King) to FRAUDULENTLY SCUTTLE the "REVIVED" Red Hook Streetcar Project in 2011?  :(

I think the "bottom line” here, is that we've now proved certain “White Collar Criminals” still employed at NYCDOT to this very day, literally stole $97,000 from the Federal Highway Administration by "Double Billing" over a decade ago, and to “Cover It Up” – NYCDOT “Miscreant Workers” blamed BHRA, scuttled our project, stole our equipment, tried to ruin our reputations (Good Will) - and are in fact STILL “Covering It Up” today…

When speaking at the Atlantic Avenue tunnel tours (2010), Your Humble Narrator began mentioning quite often, BHRA’s original Red Hook Streetcar Project, and also publicly Advocated for a new Federally funded Red Hook Streetcar Project “Feasibility Study” – the very same NYCDOT “Miscreant Workers” instantly reacted by illegally terminating the highly popular tunnel tours, in an attempt to silence Your Humble Narrator – YET AGAIN - and keep NYCDOT’s SCANDALOUS circa “FY” 1998- 1999 THEFT OF FEDERAL FUNDS “BURIED DEEP” >:(

It will be my great pleasure to see our attorney present these documents - AND MUCH MORE- to the JURY AT TRIAL :-)
